General Conditions of Sale

Article 1 Purpose

These General Conditions of Sale described below detail the rights and obligations of the company Récif'Art, registered in the Registre du Commerce et des Sociétés de Strasbourg under the number SIREN 800 359 92900018, and of its customers in connection with the sale of aquariophile equipment on the website www.reef-guardian.com.
Any service performed by the company Récif'art implies the purchaser's unreserved adherence to these General Conditions of Sale.

Article 2 Presentation of products

The characteristics of the products offered for sale are presented on each product sheet of our website. All texts and images presented on the website of Récif'Art are reserved, for the entire world, for copyright and intellectual property. Their reproduction, even partial, is strictly prohibited.

Article 3

Products are offered for sale until the stock is exhausted. Products not available in stock are indicated on the product sheet in question and can still be ordered, only the delivery time will change, the time that the company Récif'Art orders the product from the supplier concerned.
In all cases, in case of an order for a product that has become unavailable, the customer will be informed of this unavailability as soon as possible by e-mail.

Article 4 Prices of products

The product sheets of our site indicate the prices in euros All Taxes Included (VAT), excluding shipping costs. The amount of VAT is specified when selecting a product by the customer and the shipping costs appear on the screen at the end of the selection of the different products by the customer.

Récif'Art reserves the right to change its prices at any time but the products ordered are invoiced at the price in effect on the date of registration of the order.

The proposed rates include discounts and rebates which the company Récif'Art would have to grant on the basis of its results or the buyer's assumption of certain services.

No discount will be granted in case of advance payment.

Article 5 Order

The customer validates his order when he activates the "Order" link at the bottom of the summary page of his order after accepting these Terms and Conditions of Sale. Before this validation, it is systematically proposed to the customer to check each of the elements of his order, so he can correct any errors.

Récif'Art confirms the order by email. This information includes all elements of the order and the customer's right of withdrawal.

The data recorded by the company Récif'Art constitutes proof of the nature, content and date of the order. It is archived by the society Récif'Art under legal conditions and deadlines. The client can access this archive in his personal space (My Account).

Article 6

Orders are settled by means made available to you at the end of the order process (Blue card, transfer, Paypal, cheque, in several times...). The goods are only shipped from the moment the payment is accepted by our bank (cheques take a lot of time, often seven (7) to ten (10) days from the date of receipt by our service, before being able to make sure they are offsetting. Transfers are usually validated within two (2) business days from the date of receipt by our bank and the Blue Card is instantly validated.

In addition, cheque orders will be invalidated if we have not received the cheque within four (4) business days. Orders placed by bank transfer will be invalidated if we have not received it within five (5) days.

Payment in 3x free of charge is available from 150 euros.

When you choose to pay your order by credit card in three times, your order will be subject to control. The information about your order will therefore be the subject of a data processing which is intended solely to define a level of analysis of a transaction and to combat fraud of means of payment.

We ask you for proof of your identity, billing or delivery address. The failure or refusal to submit the requested proofs may lead the company Récif. The delay in the transmission of the requested supporting documents may also delay the dispatch and delivery of the products ordered. In addition, when you first order with payment in three times or as many times as we consider necessary, you will be asked for a deposit check for the amount of the last two maturities. This cheque will only be cashed if one of the maturities is outstanding, otherwise it will be destroyed on automated payment of the last maturity of your payment three times.

Recif-Art is the only recipient of the data related to your order.

The occurrence of an unpaid payment solely for fraudulent use of a credit card will automatically result in the registration of your order information in a computerized file.

In accordance with the French law Informatique et Libertés of 06 January 1978 modified, you have at all times a right of access, rectification and opposition, to all your personal data, writing and justifying your identity, to the society Recif'Art.

Failure to pay a single sum at the agreed maturity shall render all amounts due payable payable and shall result in the application of the penal clause.
For any default on maturity, and as a penal clause, the defaulting purchaser will have to pay in addition to the sale price, a lump sum of 30% of the sale price with a minimum of EUR 100 (€ 100.00). This penal clause will remain definitively acquired from the society RecifsArt, without any need to justify any harm.

The delay penalty rate is 12% (12 percent).

The costs of the letters recommended from the various re-launches, legal fees and bailiff will be reduced to the total amount due.

The company RécipoArt reserves the right to suspend or cancel any order and/or delivery, whatever its nature and level of execution, in the event of non-payment of any amount that would be due by the Buyer or in the event of a payment incident.

In case of partial reimbursement of an order settled via payment in three times, the amount of the refund will be deducted from the last maturity.

If you pay your order in 3 times or 4 times with fees, you accept the alma customer terms and conditions. and the special conditions Alma for customers of Recif'Art.

Article 7 Delivery

- All products are delivered as soon as possible, counting the time taken to prepare the order and those announced by the selected carrier. The delivery deadline may vary depending on the address. Delivery dates are indicated in a red frame on each product page. Time limits are defined in working days.
The announced non-EU delivery costs are indicative. With the new method of calculating La Poste (volume weight), it is difficult to estimate the cost precisely. If the latter differs from the estimate we then contact you to inform you and ask for your consent.
- Break during transport: Our shipments are made with insurance. This insurance can only be effective if you refuse the damaged package on receipt. If you sign and accept the package the responsibility is transferred.

Article 8 Customer relations - After-sales service

For any information, question or complaint, the customer can contact the Customer Service of the company via the contact form.

Article 9 Right of withdrawal

The customer has fourteen (14) free days from delivery to return the product, the return costs being at his expense. He is then reimbursed for all sums paid within 14 days of receipt of the order by Récif'Art. However, products returned incomplete, damaged, used, dirty or not in their original packaging as received shall not be included. The return must be with direct delivery to us (no relay point). The withdrawal form is available in your account and attached to your order confirmation email.

The right of withdrawal does not apply to live stones, as they are considered "perishable goods" (Article L 121-20-2 of the Consumer Code), or to simple tanks (aquariums) which are custom-made products.

Article 10 Loyalty Points

The vast majority of items qualify for loyalty points (except promo and/or promo code used for the split order and/or payment method). These loyalty points can be converted into a voucher from the moment the order is placed into a "Delivered" status. The promo code generated is valid for 1 year and the validity start date begins after the legal withdrawal period, 14 days after receipt of the order that generated the points. In this case go to your account, then section "My loyalty points". Then validate the points in front of the relevant command. You will then get a promo code that you can use on a next order. The validation of loyalty points must be done within 3 months of the delivery of your right order, then points are lost.

Rules: Loyalty points can be converted into a purchase order up to three months after the order date.

Article 11 Guarantee

11.1 Commercial Guarantee

In the context of the guarantee, the consumer shall be entitled to a period of two years from the date of issue of the property to have it repaired, free of charge, in the event of his default.
For certain items the VAS is insured by the brand or distributor of the product and are to be sent directly to them. In this case we inform you of the shipping address concerned by this or these item(s), the return of the item must be accompanied by the invoice issued by Recif'Art (available for download in your customer area on this site: link "My account" located at the foot of the page and then select "History and details of my orders", on each line of each validated and received order you have a download link of your invoice in pdf format). Within the framework of the commercial guarantee, the costs of return remain the responsibility of the consumer.

11.2 Legal guarantee of compliance

It is recalled that, within the framework of the legal guarantee of conformity, the consumer: has a period of two years from the date of issue of the property to act vis-à-vis his seller; may choose between repair or replacement of the property, subject to the cost conditions laid down in Article L. 211-9 of the Consumer Code above; is exempt from reporting proof of the non-conformity of the property for the six months following the issue of the property. This period is extended to 24 months from 18 March 2016, except for used goods. The legal guarantee of conformity shall apply independently of any commercial guarantee granted. The consumer may decide to implement the guarantee against hidden defects of the thing sold within the meaning of Article 1641 of the Civil Code and in this case he may choose between the resolution of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil Code. The provisions of L. 217-9 and L. 217-10 shall be applied at no cost to the purchaser. These same provisions do not preclude the award of damages. In case of non-conformity, the buyer chooses between repair and replacement of the property. However, the seller may not proceed according to the buyer's choice if the choice results in a cost clearly disproportionate to the other method, taking into account the value of the property or the extent of the defect. He is then obliged to proceed, unless impossible, according to the method not chosen by the buyer.

Article 12 Recif'Art Premium

12.1 Service Recif'Art Premium allows the customer who has subscribed to the subscription to receive, once the payment of the service is made, a 5% discount on products not already on promotion as well as express free delivery on an unlimited number of orders during the duration of the service (1 year).

12.2 Service Recif'Art Premium takes the form of a 1-year subscription, payable at one time when the service is activated. The period of 1 year starts from the date of payment of the order including the service Recif'Art Premium. At the end of the period of validity, the customer is free to renew his subscription to the service by paying the amount in force.

12.3 Free express delivery from 69 euros Recif'Art Premium is only available for deliveries in metropolitan France. All products of the site Recif'Art are eligible for the service Recif'Art Premium, unless expressly mentioned on the product sheet.

12.4 Service Recif'Art Premium is valid only for customer account Recif'Art having subscribed to the service and may only be linked to one customer account.

12.5 The customer has a legal withdrawal period of 14 days. However, if the customer receives a free discount or delivery resulting from the subscription to the service Recif'Art Premium, the customer legally renounces (Article L. 121-21-8, 1° of the Consumer Code) his right of withdrawal from service Recif'Art Premium.

12.6 Items receiving a discount via subscription Recif'Art Prime, loyalty points can no longer be allocated. Knowing that the remission Recif'Art Premium is in any case 2.5 times the value of loyalty points, subscription remains very much advantageous for the customer.

Article 13 Mediation

Legal guarantee: The client shall have two years from the date of issue of the property to act.
