Article 1: object
These General Conditions of Sale described below detail the rights and obligations of the company Récif'Art, registered in the Strasbourg Trade and Companies Register under the number SIREN 800 359 92900018, and of its customers within the framework of the sale of aquarium equipment on the website www.reef-guardian.com.
Any service performed by Récif'art implies the buyer's unreserved acceptance of these General Conditions of Sale.
Article 2 Product presentation
The characteristics of the products offered for sale are presented on each product sheet on our site. All texts and images presented on the website of the company Récif'Art are reserved, for the whole world, under copyright and intellectual property rights. Their reproduction, even partial, is strictly prohibited.
Article 3 Period of validity of sales offers
The products are offered for sale while stocks last. Products not available in stock are indicated on the product sheet in question and can still be ordered, only the delivery time will change, while the company Récif'Art orders the product from the supplier concerned.
In any case, in the event of an order for a product that has become unavailable, the customer will be informed of this unavailability, as soon as possible, by email.
Article 4 Product prices
The product sheets on our site indicate the prices in euros All taxes included (TTC), excluding shipping costs. The amount of VAT is specified during the selection of a product by the customer and the shipping costs appear on the screen at the end of the selection of the different products by the customer.
The Récif'Art company reserves the right to modify its prices at any time but the products ordered are invoiced at the price in force on the date of registration of the order.
The proposed prices include the discounts and rebates that the company Récif'Art would be required to grant given its results or the assumption by the buyer of certain services.
No discount will be granted for early payment.
Article 5 Order
The customer validates his order when he activates the "Order" link at the bottom of the summary page of his order after having accepted these General Conditions of Sale. Before this validation, the customer is systematically offered to check each of the elements of his order, he can thus correct any errors.
The Récif'Art company confirms the order by email. This information includes all the elements of the order and the customer's right of withdrawal.
The data recorded by the company Récif'Art constitutes proof of the nature, content and date of the order. This is archived by the company Récif'Art under the legal conditions and deadlines. The customer can access this archiving in his personal space (My account).
Article 6 Methods of payment
The payment of orders is made using the means available to you at the end of the ordering process (credit card, transfer, Paypal, check, in several installments ...). The merchandise is not shipped until the payment is accepted by our bank (checks take a long time, often seven (7) to ten (10) days from the date of receipt by our department, before being able to ensure that they are compensable. Transfers are generally validated within two (2) working days from the date of receipt by our bank and the credit card is validated instantly).
In addition, orders placed by check will be invalidated if we have not received the check within four (4) working days. Orders placed by bank transfer will be invalidated if we have not received it within five (5) days.
Payment in 3x free of charge is available from 150 euros incl.
When you choose to pay for your order by credit card in three installments, your order will be subject to verification. The information relating to your order will therefore be subject to data processing, the sole purpose of which is to define a level of analysis of a transaction and to fight against payment fraud.
We are required to ask you for supporting documents relating to your identity, the billing or delivery address. Failure or refusal to provide the requested supporting documents may lead Récif'Art to refuse the order concerned. The delay in sending the supporting documents requested may delay the dispatch and delivery of the products ordered by the same amount. In addition, during your first order with payment in three installments or as many times as we deem necessary, a deposit check for the amount of the last two installments will be requested. This check
will only be cashed if one of the installments were to be unpaid, otherwise it will be destroyed during the automated payment of the last installment of your payment three times.
Récif'Art is the sole recipient of the data relating to your order.
The occurrence of an unpaid bill for the sole reason of fraudulent use of a bank card will automatically result in the registration of the contact details relating to your order in a computerized file.
In accordance with the amended French Data Protection Act of January 6, 1978, you have the right to access, rectify and oppose all of your personal data at all times, by writing and justifying your identity, to the company Recif'Art.
Failure to pay a single sum by the agreed deadline makes all of the sums due payable and will result in the application of the penalty clause.
For any default of payment on the due date, and as a penalty clause, the defaulting purchaser must pay in addition to the sale price, a sum of a lump sum of 30% of the sale price with a minimum of one hundred euros (€. 100.00). This penalty clause will remain definitively acquired by Récif'Art, without there being any need to justify any damage.
The late penalty rate is equal to 12% (twelve percent).
The costs of registered mail for various reminders, court costs and bailiffs will be added to the total amount payable.
The Récif'Art company reserves the right to suspend or cancel any order and / or delivery, whatever its nature and level of execution, in the event of non-payment of any amount due by the Buyer or in the event of a payment incident.
In the event of a partial refund of an order paid by payment in three installments, the amount of the refund will be deducted from the last installment.
Payment in installments with Alma.
If you pay for your order in 3 installments or 4 installments with charges, you accept Alma's general customer conditions. as well as the Alma special conditions for Recif'Art customers.
Article 7 Delivery
- Any product is delivered as quickly as possible, including the preparation times for the order and those announced by the selected carrier. The delivery deadline may vary depending on the address. Delivery dates are shown in a red frame on each product page. The deadlines are understood in working days.
The announced delivery costs outside the EU are indicative. With La Poste's new calculation method (volumetric weight), it is difficult for us to estimate the cost precisely. If the latter differs from the estimate we will then contact you to inform you and ask for your agreement.
- Breakage during transport: Our shipments are made with insurance. This insurance can only be effective if you refuse the damaged package upon receipt. If you sign and accept the package responsibility is transferred.
Article 8 Customer relations - After-sales service
For any information, question or complaint, the customer can contact the company's Customer Service via the contact form.
Article 9 Right of withdrawal
The customer has fourteen (14) clear days from delivery to return the product, the return costs being his responsibility. It is then reimbursed for all sums paid within 14 days of the date of receipt of the order by the company Récif'Art. However, products returned incomplete, damaged, used, soiled or not in their original packaging as they were received are not taken back. The right of withdrawal does not apply for live stones, because they are considered "perishable goods" (Article L 121-20-2 of the Consumer Code).
Article 10 Loyalty points
The vast majority of items entitle to loyalty points (except promotions and / or promo code used for the order and / or 3x payment method free of charge). These loyalty points can be converted into a voucher from the moment the order is placed in "Delivered" status. The promo code thus generated is valid for 1 year and the start date of validity begins after the legal withdrawal period, i.e. 14 days after receipt of the order that generated the points. In this case go to your account, then section "My loyalty points". Then validate the points in front of the order concerned. You then get a promo code that you can use on a next order. The validation of loyalty points must be done within 3 months after delivery of your order entitled, then the points are lost.
Rules: The generated promo code is only valid on an order exceeding one hundred (120) euros including tax. Loyalty points can be converted into a voucher up to three months after the order date.
Article 11 Guarantee
11.1 Commercial warranty
Within the framework of the guarantee, the consumer benefits from a period of two years from the delivery of the good to have it repaired, free of charge, in the event of defect of the latter.
For certain items, after-sales service is provided by the product brand or distributor and must be sent directly to them. Within the framework of the commercial guarantee, the return costs remain the responsibility of the consumer.
11.2 Legal guarantee of conformity
It is recalled that within the framework of the legal guarantee of conformity, the consumer: benefits from a period of two years from the delivery of the good to act vis-à-vis its seller; may choose between repair or replacement of the item, subject to the cost conditions provided for in Article L. 211-9 of the Consumer Code above; is exempt from providing proof of the existence of the lack of conformity of the goods during the six months following delivery of the goods. This period is extended to 24 months from March 18, 2016, except for second-hand goods. The legal guarantee of conformity applies regardless of any commercial guarantee granted. The consumer can decide to implement the guarantee against hidden defects of the thing sold within the meaning of article 1641 of the civil code and that in this case, he can choose between the resolution of the sale or a reduction of the sale price. in accordance with article 1644 of the Civil Code. The provisions of Articles L. 217-9 and L. 217-10 are applied at no cost to the buyer. These same provisions do not preclude the award of damages. In case of lack of conformity, the buyer chooses between repair and replacement of the good. However, the seller may not proceed according to the buyer's choice if this choice entails a manifestly disproportionate cost compared to the other modality, taking into account the value of the goods or the importance of the defect. He is then required to proceed, unless this is impossible, according to the method not chosen by the buyer.
Article 12 Recif'Art Prime
12.1 The Recif'Art Prime service allows the customer having subscribed to the subscription to benefit, once payment for the service has been made, from a 5% discount on products not already on promotion as well as free express delivery on an unlimited number. of orders during the service period (1 year).
12.2 The Recif'Art Prime service takes the form of a 1 year subscription, payable in one go upon activation of the service. The period of 1 year starts from the date of payment of the order including the Recif'Art Prime service. At the end of the validity period, the customer is free to renew his subscription to the service by paying the amount in force.
12.3 The free express delivery offer from 69 euros of order of Recif'Art Prime is only available for deliveries in mainland France. All the products on the Recif'Art site are eligible for the Recif'Art Prime service, except for the exceptions expressly mentioned on the product sheet.
12.4 The Recif'Art Prime service is only valid for the Recif'Art customer account having subscribed to the service and can only be linked to one customer account.
12.5 The customer has a statutory withdrawal period of 14 days. However, as soon as the customer benefits from a discount or free delivery resulting from the subscription to the Recif'Art Prime service, the customer legally waives (Article L. 121-21-8, 1 ° of the Consumer Code) his Right of withdrawal from the Recif'Art Prime service.
12.6 As articles benefiting from a discount via the Recif'Art Prime subscription, loyalty points can no longer be allocated. Knowing that the Recif'Art Prime discount is in any case 2.5 times the value of the loyalty points, the subscription remains very advantageous for the customer.
